The report (PN5) sets out 3 current applications for County Council development, made under Regulation 3 of the Town and Country Planning General R egulations 1992, are detailed in the schedules appended to the report:-

(Application No C.19/04. Retention on site of a metal storage container for storage of sports equipment for a temporary period of five years at Cooper School, Churchill Road, Bicester.

Application No S.18/04. Erection of extension to existing classroom formation of secure Early Years play area and extension to existing main playground at Lewknor CE Primary School, High Street, Lewknor, Watlington.

Application No C.17/02. Alterations and extensions to existing Magistrates Court, demolition of existing garage and alterations to existing car park layout, northern Oxfordshire Magistrates Court, The Courthouse, Warwick Road, Banbury.)

The fourth section of the report has been placed on the agenda at the request of Councillor Power under Section FF (paragraph 7(d)(iii)) of the Constitution and refers to the creation of a new access through the boundary wall of St Thomas’ Day Nursery. The nursery is adjacent to Hollybush Lodge, which is now the subject of a planning application to the City Council for office and residential accommodation. Whilst there has been some long standing concern about joint access for children to the Day Nursery with parking space within the Hollybush Lodge site, the particular concern at the moment is (in the event of any permission for redevelopment proposals) the use of the access by contractors during site construction works.

The Committee is RECOMMENDED:

(a) that subject to consideration of any further representations received by the date of the meeting, the 3 applications set out above be determined as recommended in the schedules appended to the report, subject to the detailed wording of the recommended conditions being determined by the Director for Environment & Economy;

(b) with regard to the St Thomas’ Day Nursery to note the contents of the report and endorse the action set out in paragraph 14 to ask officers to convene a meeting between all interested parties, namely the City Council planners, the developer of the Hollybush Lodge site, the Management Committee of the Day Nursery, English Heritage and the Parochial Church Council in order to agree a way forward which would allow development to take place without compromising the safety of users of the Day Nursery.
