Any county councillor may, by giving notice to the Proper Officer by 9 am two working days before the meeting, ask a question on any matter in respect of the Cabinet Member’s delegated powers.

The number of questions which may be asked by any councillor at any one meeting is limited to two (or one question with notice and a supplementary question at the meeting) and the time for questions will be limited to 30 minutes in total. As with questions at Council, any questions which remain unanswered at the end of this item will receive a written response.

There were no questions from County Councillors.

Currently council meetings are taking place in-person (not virtually) with some social distancing still operating in the venues.  However, members of the public who wish to speak at this meeting can attend the meeting ‘virtually’ through an online connection.  Places at the meeting are still being managed to try and respect the requirements of social distancing and while you can ask to attend the meeting in person, you are strongly encouraged to attend ‘virtually’ to minimise the risk of Covid-19 infection.

Please also note that in line with current government guidance all attendees are strongly encouraged to take a lateral flow test in advance of the meeting.

Normally requests to speak at this public meeting are required by 9 am on the day preceding the published date of the meeting. However, during the current situation and to facilitate these new arrangements we are asking that requests to speak are submitted by no later than 9am four working days before the meeting i.e. 9 am on Friday 21st January 2021. Quickways and Quietways are proposals in the Oxford Local Cycling and Walking Infrastructure Plan (LCWIP) as an effective way of promoting cycling, in line with council objectives of public health, decongestion, climate change and air quality. East Oxford was chosen as a priority area as it has below average levels of cycling for the city. Quickways are proposed on main routes in the city, with the following routes consulted on: Cowley Road/Oxford Road, Donnington Bridge Road, Iffley Road/Henley Avenue/Rose Hill, Marston Road, Morrell Avenue/Warneford Lane, St Clement’s Street, Between Towns Road/Church Cowley Road and Banbury Road/St Giles.

A Quietway is proposed to be introduced on Parks Road in North Oxford.

The 20mph speed limit amendments proposed on the Quickways included provision of a 20mph speed limit on Abingdon Road, where cycle improvements were implemented as part of Active Travel Tranche 1. Following the consultation, the 20mph speed limit on Donnington Bridge Road is proposed to be extended to include Weirs Lane.

Quickways and the Quietway cycle routes have been presented to key stakeholders through extensive consultation. A total of 1,448 online responses were received from the informal consultation and 909 responses for the statutory TRO consultation. The consultation found that respondents showed good support for the proposed Quickways and Quietway.  75% of respondents to the informal consultation supported the proposals, with 21% objecting and 4% remaining neutral.

Across both consultations is clear that respondents largely supported the Quickway routes. There were some key objections which have been noted and addressed where possible. These included but were not limited to loss of parking including disabled provision and a desire for more infrastructure particularly at junctions.

Following consultation, a priority ranking exercise was undertaken, and it is recommended to defer the Between Towns Road/Church Cowley Road and Banbury Road. An order of preference has been identified for delivery to ensure the scheme remains within the budgetary constraints.

The Cabinet Member for Highway management is RECOMMENDED to:

a.     Approve implementation of the Marston Road, Cowley Road/Oxford Road, Iffley Road/Henley Road/Rose Hill and Morrell Avenue/Warneford Lane Quickways with the understanding that, once detailed design costs are finalised and should available budget allow, additional schemes on the prioritisation list can be brought back into the programme.

b.     Approve implementation of all the 20mph speed limits incorporating the extension of the 20mph speed limit on Weirs Lane.

The Cabinet Member for Highway Management, Councillor Bearder, considered a report of the Corporate Director Environment & Place (CMDHM4) on the proposed introduction of Quickways and Quietways as part of the Oxford Local Cycling and Walking Infrastructure Plan (LCWIP), and the responses received following a statutory consultation on the proposals.

The report noted that the introduction of Quickways and Quietways was viewed as an effective way of promoting cycling in line with the Council’s objectives in relation to public health, [traffic] decongestion, climate change, and air quality. Having reviewed the responses to the statutory consultation, it was RECOMMENDED that the Cabinet Member for Highway Management approve implementation of –

(a)  The Marston Road, Cowley Road/Oxford Road, Iffley Road/Henley Road/Rose Hill and Morrell Ave/Warneford Lane Quickways as advertised with the understanding that, once detailed design costs are finalised and should available budget allow, additional schemes on the prioritisation list can be brought back into the programme; and

(b)  All the 20mph speed limits as advertised incorporating the extension of the 20mph speed limit on Weirs Lane.

Councillor Bearder then invited those persons present, either in person or online, to make their presentations on the proposals. In so doing, Councillor Bearder noted that he had also received written representations on the proposals which he would take into consideration before announcing his decision.

Having heard the oral presentations and having received written representations, Councillor Bearder made the following observations.

(a)  The presentations and representations reflected the complexity of the proposals that were before him today and he thanked everyone for their presentations and written representations.

(b)  He was aware that the proposals, if approved, represented a significant change which had implications for vulnerable persons.

(c)   In reaching a decision, it was necessary to take into consideration those persons who will be put in a vulnerable situation, including very many students who were limited in their means of transport.

(d)  It was necessary to take urgent and dramatic action, as reflected in the proposals set out in the report, if the issues raised by climate change were to be addressed.

(e)  The proposals would not achieve everything and, therefore, it would be necessary to give the proposals further consideration.

(f)    That people paved over gardens to create car parking space; parked on pavements; and ignored 20 mph speed limits, while deeply frustrating, was not justification for not considering the proposals set out in the report.

In response to the criticism that there were insufficient enforcement powers available to address these concerns, it was incumbent upon those who could, to press the relevant authorities on these issues.

[Councillor Bearder then cited the example of the significant success in reducing vehicle speeds in Kiev following the introduction of automatic number plate recognition (ANPR) systems in Kiev].

(g)  It was a priority of the Council to introduce a more sustainable, environmental, and safer, transport network which reflected the needs of the most vulnerable persons in society.

The report presents responses received to a statutory consultation on a proposal to make permanent the provisions of a temporary traffic regulation order (made under the Department for Transport COVID regulations) prohibiting all vehicles using the 50 metre length of the street west of its junction with Cornmarket Street to enable outdoor seating to be provided for the adjacent hospitality businesses. This proposal has been received from Oxford City Council’s Business Liaison Officer at the request of the adjacent businesses with the intention - should the proposal be approved – for the permanent measures to be in force before the expiry of the current temporary order on 3 March 2022. Exemptions to the restrictions would apply to emergency service vehicles and for vehicles requiring access to adjacent premises.

The Cabinet Member for Highway Management is RECOMMENDED to approve as advertised the prohibition of all vehicles from its junction with Cornmarket Street westwards for approximately 50 metres but as an experimental rather than permanent order noting the concerns raised.  This would allow potential actions to mitigate the impact of the closure on cyclists to be investigated – as set out in paragraph 12 of the report CMDHM6.

The Cabinet Member for Highway Management, Councillor Bearder, considered a report of the Corporate Director Environment & Place (CMDHM6) RECOMMENDING the prohibition of all vehicles from the junction of Cornmarket Street westwards for approximately 50 m but, in response to concerns raised about the proposal, as an experimental order and not a permanent order. It was proposed that, in so doing, this would allow investigation of potential actions to mitigate the impact of the closure might have on cyclists.

The report presents responses received to a statutory consultation to introduce no waiting at any time restrictions at Hixet Wood to facilitate the safe access to and from a new residential development, including enabling bin lorries to enter and exit the site. Funding for consultation on the proposals has been provided by the developer of land off Hixet Wood who will also fund implementation of the proposals should they be approved.

The Cabinet Member for Highway Management is RECOMMENDED to approve as advertised the proposed no waiting at any time restrictions at Hixet Wood, Charlbury.

The Cabinet Member for Highway Management, Councillor Bearder, considered a report of the Corporate Director Environment & Place (CMDHM11) presenting responses received to a statutory consultation to introduce no waiting at any time restrictions at Hixet Wood to facilitate the safe access to and from a new residential development, including enabling bin lorries to enter and exit the site.

It was RECOMMENDED that the Cabinet Member for Highway Management approve, as advertised: the proposed no waiting at any time restrictions at Hixet Wood, Charlbury.

In response to a question by Councillor Bearder, the Clerk informed the meeting that Councillor Leffman, who had planned to speak on this item, had intimated that she may not be able to attend the meeting due to other commitments. Councillor Bearder noted that he had received her representation which opposed the proposals as set out in the report.

At the conclusion of the presentations, Councillor Bearder made the following observations.

(a)  It appeared that not all persons may had been notified of the possible loss of parking space that would occur if the proposals were implemented.

[MJA Consulting subsequently corrected a statement made during their presentation and confirmed that they had been involved in the planning stage of the proposals].

(b)  This was a quiet area which did not have many cyclists passing through. As such, cyclists that did pass through could use the full extent of the road to avoid potential collisions with people opening car doors.

(c)   Accordingly, he was of the view that the proposals were unnecessary.

Therefore, having considered the report of the Director of Growth and Economy; the written representations that had been received in response to the consultation; and the presentations by those persons present at the meeting, either in person or online, Councillor Bearder announced his decision, as follows:

The report presents responses received to a statutory consultation on proposals to extend the 40mph speed limit on the B4047 at Minster Lovell because of adjacent development. It should be noted that a consultation on the same proposal was carried out in June and July 2019 with no objections but as the order was not made within two years of the consultation (although some works were carried out on site), national regulations on traffic orders require a further consultation. Funding for consultation on the proposals has been provided by the developers of the adjacent land who will also fund the extension of the limit if approved.

The Cabinet Member for Highway Management is RECOMMENDED to approve as advertised the proposed extension of the 40mph speed limit on the B4047 at Minster Lovell and ask officers to assess and provide costings to Minster Lovell Parish Council for a further reduction of the speed limit to 30mph.

The Cabinet Member for Highway Management, Councillor Bearder, considered a report of the Corporate Director Environment & Place (CMDHM12) presenting responses received to a statutory consultation to extend the 40mph speed limit on the B4047 at Minster Lovell because of adjacent development.

A consultation on the same proposal had been carried out in June and July 2019 and no objections had been received to the proposal. However, as the Order was not made within two years of the consultation national regulations on traffic orders required that there be a further consultation.

It was RECOMMENDED that the Cabinet Member for Highway Management approve, as advertised, the proposed extension of the 40mph speed limit on the B4047 at Minster Lovell and ask officers to assess and provide costings to Minster Lovell Parish Council for a further reduction of the speed limit to 30mph.

Having considered the report of the Director of Growth and Economy, Councillor Bearder, announced his decision, as follows:
