OXFORDSHIRE MINERALS AND WASTE DEVELOPMENT FRAMEWORK: STATEMENT OF COMMUNITY INVOLVEMENT

Report by Head of Sustainable Development

Introduction

  1. Following consideration by the Cabinet on 20 December 2005, the Council on 10 January 2006 approved the Oxfordshire Minerals and Waste Development Framework, Statement of Community Involvement (SCI) and authorised the Head of Sustainable Development, in consultation with the Cabinet Member for Sustainable Development, to finalise the SCI for submission to the Secretary of State. The SCI was submitted to the Secretary of State on 22 February 2006. The submitted SCI was published on the Council’s website and a copy was sent to all County Council Members.
  2. The period for making representations on the submitted SCI ended on 5 April. A total of 93 representations have been received, from 35 organisations and individuals. The representations can be seen in the Members Resource Centre and are available for public inspection at Speedwell House. We are analysing these representations and preparing a report on them, which will be sent to the Secretary of State and the Inspector appointed by the Secretary of State to carry out the independent examination of the SCI. This report will also be published on the Council’s website.
  3. The independent examination is programmed to be carried out in June; we hope that this will be done through written representations, without the need for oral hearings before the Inspector. We expect to receive the Inspector’s Report in August and to report the SCI, with any changes recommended by the Inspector, to the Cabinet in October and to the Council in November for adoption.
  4. Response to Representations

  5. The new local development framework system of plan-making does not allow for authorities to propose changes to the document that has been submitted to the Secretary of State for Examination. But the Inspector will want to know the Council’s responses to the representations that have been made, including whether the Council agrees or disagrees with them and the reasons why.
  6. The Inspector will set a timetable for the submission of papers for the Examination. The timescale for submitting the Council’s responses is expected to be tight. To enable the Council to make its responses at the required time, I am recommending that the Cabinet authorises me to agree them in consultation with the Cabinet Member for Sustainable Development. This authorisation would also provide flexibility to enable me to make further submissions to the Inspector should this be necessary.
  7. Financial and Staff Implications

  8. There are no resource implications beyond those already provided for in the project management of the Oxfordshire Minerals and Waste Development Framework.
  9. RECOMMENDATION

  10. The Cabinet is RECOMMENDED to authorise the Head of Sustainable Development, in consultation with the Cabinet Member for Sustainable Development, to respond to the representations on the Submitted Statement of Community Involvement and to submit these responses and any other submissions that may be necessary to the Secretary of State and the Inspector appointed to hold the Independent Examination into the Statement of Community Involvement.
