PLANNING & REGULATION COMMITTEE –

MINERALS AND WASTE PLANNING APPLICATION

  1. The main part of the application is to carry out the development under permission 0109/94 without complying with condition 4. Condition 4 states:
  2. "The extraction of sand and gravel is not permitted other than from the working phases defined on approved plan no: 8616/A/2d"

    The applicants have requested that this condition is replaced by the following amended condition:

    "The extraction of sand and gravel is not permitted other than from the working phases defined on approved plan no: 8616/A/2e".

  3. To carry on development under permission 0109/94 without complying with condition 12 is the second part of the application. Condition 12 of permission 0109/94, states:

"With the exception of necessary works arising from emergency situations and unless otherwise agreed in writing by the local planning authority, lorries shall not enter or leave the site, plant shall not be operated and operations shall not take place

    1. in phases 4 and 6 of the Tar Farm Reserve Block and within 350 m of Hardwick village
      1. other than between 0800 and 1700 hours Monday to Friday,
      2. at any times on Saturdays, Sundays and Bank Holidays and

    2. in the remainder of the site
      1. other than between 0700 and 1800 hours Monday to Friday and 0700 and 1300 hours Saturdays
      2. at any time on Sundays and Bank Holidays and Saturdays immediately following Bank Holidays"

The applicants have requested that this condition is replaced by the following amended condition:

(a) in phases 4 and 6 of the Tar Farm Reserve Block and within 350 m of Hardwick village

      (b) in the area outlined in orange on approved plan 8616/A/2e

      (i) other than between 0600 and 1900 hours Monday to Friday, and 0600-1600 hours Saturdays and

      (ii) at any time on Sundays and Bank Holidays

      (c) in the remainder of the site

      (i) other than between 0700 and 1800 hours Monday to Friday and 0700 and 1300 hours Saturdays

      (ii) at any time on Sundays and Bank Holidays and Saturdays immediately following Bank Holidays"
