- The development
hereby permitted shall be for a limited period expiring on 31 December
2010. All structures and plant must be dismantled and removed from the
site and the site shall be restored to agricultural use by the 31 August
2011.
Reason:
To provide for the completion and progressive restoration of the site
within the approved timescale.
- The development
shall be carried out solely in accordance with the details submitted
with the application unless modified by the conditions of this permission.
Reason:
For the avoidance of doubt and to maintain planning control over the
site.

- No green waste
shall be brought to the site or compost exported from the site or machinery
operated except between the following times:
(a) 08.00
to 17.00 Mondays to Friday and 08.00 to 12.30 Saturdays; and

any time on Sundays and Bank Holidays and Saturdays immediately following
Bank Holidays
Reason:
In the interests of the amenities of nearby residents.

- The site shall
be used only for the composting of green waste and for no other purpose
whatsoever.

To enable the Waste Planning Authority to retain control over the development.

than green garden or parks waste shall be imported to the site. For
the avoidance of doubt kitchen waste and animal waste shall not be imported
to the site.

- No material shall
be stockpiled, deposited or windrowed to a height exceeding 3 metres.

- No floodlighting
shall be erected on site without the prior approval in writing of the
Waste Planning Authority.

In the interests of the amenities of nearby residents.

Vegetation
- All existing trees
and hedges on or immediately adjoining the site as shown on approved
plan 0160-1-013 revision 1 shall be retained.

To ensure the continuity of amenity afforded by existing trees or hedges.

Water
Pollution
- The construction
of the surface and foul drainage system shall be carried out in accordance
with details submitted to and approved by the Waste Planning Authority
before the development commences.
Reason:
To prevent pollution of the water environment.

- During construction
no solid matter shall be stored within 10 metres of the banks of the
drain leading to the Churbury Brook and thereafter no storage of materials
shall be permitted in this area.
Reason:
To prevent solid materials from entering the drain leading to the Cherbury
Brook and causing pollution.

Access
- The surface of
the site access shall be maintained in a good state of repair and kept
clean and free from mud and other debris at all times until such time
as it is no longer required for these operations.
Reason:
In the interests of highway safety and safeguarding the local environment.

Dust
- In periods of
dry weather a water bowser shall be used to spray water on the surface
of the site and stockpiles.
Reason:
To suppress dust.

- A soil bund shall
be constructed around the perimeter of the site before the composting
operation commences. The bund shall be 2 metres high except on the north
eastern boundary where it shall be 3 metres high. The bund shall be
seeded with rye grass mix and shall be kept free of weeds and the grass
shall be cut regularly. The bund shall be constructed so that the outside
of the bund should be at an angle of 30 degrees to the horizontal. The
bund shall be rounded at the top and feathered in to ground level so
that there is no sharp angle. The top of the bund shall be graded to
an even height of 2 metres. The bund shall be constructed as set out
in this condition unless otherwise agreed in writing by the Waste Planning
Authority.

To mitigate noise and dust and in the interest of local and visual amenity.

Odour
- In the event that
there are justified complaints about offensive odours from this site,
then a scheme shall be submitted within one month of the Waste Planning
Authority notifying the operator in writing that nuisance has occurred
and that a scheme is necessary. Any scheme approved in writing by the
Waste Planning Authority shall be implemented immediately.

In the interest of the amenity of nearby residents.

Noise
- No plant, machinery
or vehicles shall be used on the site unless fitted with effective silencers.
Reason:
To safeguard the amenity of the area and local residents.

trailer shall enter the public highway unless their wheels and chassis
have been cleaned to prevent material being deposited on the highway.

Other
- Before development
commences the dimensions and elevations of the kiosk shall be submitted
to the Waste Planning Authority. Any details that are approved shall
be implemented.
