MINERALS AND WASTE PLANNING APPLICATION

Schedule 1 Conditions

  1. The development shall be carried out strictly in accordance with the particulars of the development, plans and specifications contained in the application except as modified by the conditions of this permission.
  2. Reason: To ensure that the development is carried out as proposed.

    Planting

  3. In the event of the failure of any trees or shrubs planted in accordance with the provisions of this planning permission, or existing trees and shrubs on the site (for the avoidance of doubt this includes those on either side of the site haul road), such trees or shrubs shall be replaced in the next planting season (November to February) for the duration of the development and aftercare period hereby approved. Any trees or shrubs shall be replaced with others of similar size and species unless otherwise agreed in writing by the Waste Planning Authority.
  4. Reason: To ensure the standard of planting and landscaping is maintained.

    Vehicle movements and site access

  5. No vehicle associated with the development hereby approved shall enter or leave the site other than from or to the south.
  6. Reason: To prevent the use of unsuitable roads by heavy goods vehicles.

    Policy: OMWLP W3 OSP T18

  7. No development shall take place until signs are erected at the exit of the site and at the exit point of the roundabout where the B4155 joins Dunsden Green Lane to advise vehicles accessing the site to travel at a maximum speed of 10mph. A scheme shall be submitted to the Waste Planning Authority which shall detail the wording and dimensions of the signs. Any scheme that is approved shall be implemented. This scheme shall only be revised with the prior written consent of the Waste Planning Authority.
  8. Reason: To protect the amenity of the village of Playhatch.

  9. No vehicle shall leave the site unless its wheels are sufficiently clean to prevent mud, dust or debris being carried onto the public highway.
  10. Reason: In the interests of highway safety.

    Policy: OSP T18, EN2

  11. Before development commences a scheme shall be submitted to the Waste Planning Authority which details a revised location for the gates to the site. This scheme shall ensure that it is possible for a lorry to turn entirely off the public highway in the event that the site gates are closed. This scheme shall also include the design and colour of the gates which shall be in keeping with the surrounding area. Any scheme which is approved shall be implemented.
  12. Reason: In the interests of highway safety.

    Throughput

  13. No more than 70,000 tonnes of construction and demolition waste shall be processed at the site per calendar year.
  14. Reason: In the interests of the amenity of local residents.

    Operating hours

  15. With the exception of necessary works arising from emergency situations and unless otherwise agreed in writing by the Waste Planning Authority, lorries shall not enter or leave the site, plant and machinery shall not be operated and operations shall not take place:

  1. other than between 0700 and 1700 hours Monday to Friday and 0700 to 1300 hours on Saturdays; and
  2. at any time on Sundays and Bank Holidays and Saturdays immediately following Bank Holidays.

Reason: To minimise noise disturbance to neighbouring residents.

Noise and dust

  1. All internal site haul roads shall be maintained in a condition free from pot holes while in use and shall be removed when no longer required or during the course of site restoration whichever is the sooner.
  2. Reason: To minimise noise disturbance to neighbouring residents.

  3. Vehicles within the site must not exceed a speed of 10mph.
  4. Reason: To minimise noise and dust within the site.

    Policy: OMWLP W3, PE18

  5. In the event that there are qualified complaints about levels of dust arising at the site a scheme for dust reduction to an acceptable level shall be submitted for approval by the Waste Planning Authority within one month of the date of the breach. Any scheme that is approved shall be implemented immediately.
  6. Reason: To minimise dust within the site.

  7. Audible vehicle reversing alarms from site stationed plant and vehicles shall not be audible at or past the quarry boundary.
  8. Reason: In the interests of the amenity of neighbouring residents.

    Policy: OMWLP W3, PE18 OSP EN1, EN2

  9. The site shall be laid out to minimise the need for road vehicles fitted with audible reversing alarms to reverse on the site.
  10. Reason: In the interests of neighbouring residents.

    Policy: OMWLP W3, PE18 OSP EN1, EN2

  11. No percussion machines for breaking up of individual rocks shall be used on the site
  12. Reason: In the interests of neighbouring residents.

    Policy: OMWLP W3, PE18 OSP EN1, EN2

  13. All crushing, screening and other stone size reduction operations to be carried out at such location within the site that operations and equipment are not visible from the extent of the quarry boundary defined in blue on drawing P099m/06 below a height of 1.4 metres above ground level. In addition, no stockpile shall exceed the height of the site boundary at any point of the site.
  14. Reason: In the interests of the amenity of neighbouring residents.

  15. Noise from the operations shall not exceed 55 dB LAeq, 1h (free field) measured at least 3.5 metres from the façade of any occupied residential property. In the event that qualified noise complaints are received, a scheme for noise reduction to a level below that stated above will be submitted to the Waste Planning Authority within one month of the date of the breach and any scheme that is approved shall be implemented immediately.
  16. Reason: In the interests of neighbouring residents.

    Other site operations

  17. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995, or any Order amending, revoking or re-enacting that Order, no structure or building of any kind shall be erected within the curtilage of the site without the prior written approval of the Waste Planning Authority.
  18. Reason: In the interest of the amenities of the locality.

  19. No floodlighting shall be erected on site without the prior written approval of the Waste Planning Authority.
  20. Reason: In the interests of the amenities of local residents.

    Policy: OSP G2, EN1, EN2, EN4

    Liaison with local residents

  21. No development shall take place unless a local liaison committee has been formed and continues to operate. It shall include local representatives and representatives of the site operators as may be agreed by the County Council.

Reason: To ensure that the conditions of this permission are properly implemented.

Informatives

The prior written consent of the Environment Agency is required for any discharge of sewage or trade effluent into controlled waters (e.g. watercourses and underground waters), and may be required for any discharge of surface water to such controlled waters or for any discharge of sewage or trade effluent from buildings or fixed plant into or onto ground or into waters which are not controlled waters.

Under the terms of the Water Resources Act 1991, an abstraction license will normally be required from the Environment Agency for the abstraction (removal) of water (even temporarily) from any inland waters (rivers, streams, ditches, lakes, etc.) or underground strata (e.g. from a well, borehole or catchpit).
