Report by Head of Transport (TDC5) Minutes: Officers advised that since publication of the report Thames Valley Police had advised that if a driver parked opposite an occupied DPPP, and in so doing blocked the road, and provided it could be established that the DPPP had been occupied first then the driver of that vehicle could be charged with obstruction. If the DPPP was empty and there were no restrictions on parking on the opposite side of the road, there would be nothing to prevent a driver parking opposite the DPPP. If subsequently a vehicle correctly displaying a Blue Badge then parked in the DPPP and caused the road to be blocked, then the driver of the Blue Badged vehicle would be guilty of obstruction. There was reason to believe that this scenario could occur in Horton Avenue, Thame and therefore frustrate the use of the proposed disabled space. Accordingly officers were now recommending that this proposal be withdrawn pending a review of the situation. The Cabinet Member accepted the officers advice but asked that the review be carried out as soon as possible. to authorise variations to the Oxfordshire County Council (South Oxfordshire District) (Disabled Persons’ Parking Places) Order 2006 as amended in the report CMDT5 to provide for: (a) withdrawal of the proposal to provide a DPPP in Horton Avenue, Thame pending further review; (b) twelve new DPPPs as set out in Annex 1 to the report; (c) the formalisation of five existing advisory DPPPs as set out in Annex 1 to the report CMDT5; (d) the removal of two existing DPPPs, as set out in Annex 1 to the report CMDT5..
