CABINET MEMBER FOR TRANSPORT – 24 APRIL 2008

 

PARKING AND TRAFFIC REGULATIONS OUTSIDE LONDON ADJUDICATION COMMITTEE - MEMBERSHIP

Introduction

 

1.                  This report is seeking approval for Oxfordshire County Council to become a founder member of the Parking And Traffic Regulations Outside London Adjudication Joint Committee.

 

Background

 

2.                  As part of its requirements for implementing Civil Enforcement there was a statutory requirement for the Authority to be a member of the National Parking Adjudication Service. Indeed Oxfordshire were one of the core members when the service was set up at the onset of Decriminalised Parking outside of London.

 

3.                  With the introduction of Bus Lane Enforcement, and proposed new legislation giving authorities the ability to enforce other moving traffic offences, NPAS is being disbanded, and a replacement service, the Parking and Traffic Regulations Outside London Adjudication Committee (PATROL) is being formed.  It has also transpired that any council bringing in civil enforcement of parking contraventions after 31 March 2008 must join a new committee constituted under the new legislation (and is not eligible to join the existing committee)

 

4.                  In order to meet its statutory requirement of being a member of this new Committee the Authority needs to complete a new agreement with other authorities  (including the Lead Authority,  Manchester City Council) no later than 28/29 April to the intent that  the new arrangements will come into effect on 16 May 2008.  The urgency is due to the need to have the new committee in place for the new civil enforcement authorities who will begin operating in May 2008.

 

 

Financial Implications (including Revenue)

 

5.                  There are no additional financial implications with respect to the new arrangements.

 

RECOMMENDATION

 

6.                  The Cabinet Member for Transport is RECOMMENDED to

 

(a)               approve that Oxfordshire County Council becomes a member of the Parking and Traffic Regulations Outside London Adjudication Committee; and

 

(b)              nominate member representation for Committee member and deputy of the Parking and Traffic Regulations Outside London Adjudication Committee.
