Statement of Decision

 

Parking and Traffic Regulations Outside London Adjudication Committee - Membership

Recent changes to bus lane enforcement and proposed new legislation required modifications to arrangements for the National Parking Adjudication Service Joint Committee (set up under the Traffic Management Act 2004) of which Oxfordshire County Council is a member. Manchester City Council,  the lead authority for the joint committee, had indicated that in practice that change would require the existing joint committee to be disbanded and a new Parking and Traffic Regulations Outside London Adjudication Committee established. No material changes have been proposed but in order to meet its statutory requirement of being a member of this new Committee the County Council needed to complete a new agreement with other authorities before 28 or 29 April 2008 for any change to take effect.   

 

As this item was not in the Forward Plan the Chairman of the Environment & Economy Scrutiny Committee was notified of the need that this item needed to be considered urgently under the provisions contained in Rule 16 (Special Urgency) of the Access to Information Procedure Rules of the Constitution. Also the need to advise Manchester City Council of the County Council’s decision by the 28 or 29 April did not allow sufficient time to invoke the call in process as set out in the Constitution under Rule 17a of the Scrutiny Procedure Rules and the Chairman of the Council agreed that any decision should be exempt from the call in process as delay would seriously prejudice the Council’s interests in that the Agreement would not come into effect on the due date.

 

Cabinet Member’s Comments

 

Councillor Hudspeth declared that he was satisfied with the reasons for urgency and considered the Item accordingly.

 

 

Decision

 

Having regard to the arguments and options set out in the documentation before me, the representations made to me and the further considerations set out above, I confirm my decisions on this matter as follows:

 

(a)              that Oxfordshire County Council become a member of the Parking and Traffic Regulations Outside London Adjudication Committee; and

 

(b)              that the Cabinet Member for Transport (currently Councillor Hudspeth) continue as the County Council’s representative on the Parking and Traffic Regulations Outside London Adjudication Committee with the Deputy Leader (currently Councillor Robertson) as  deputy representative;

 

(c)        to record that in the opinion of the Cabinet Member for Transport the decisions made in (a) and (b) above were urgent in that any delay likely to be caused by the call in process would seriously prejudice the Council’s interests in that the Agreement would not come into effect on the due date and in accordance with the requirements of Scrutiny Procedure Rule 17(b) those decisions should not be subject to the call in process.
