Summary of representations in person

Councillor Armitage requested that paragraph 3 of the Gating Order Protocol (Annex 1 to the report CMDT4) be slightly modified by adding "unless specifically agreed by the owners of any affected dwelling" and enquired whether there would be a backlog of requests.

Councillor McIntosh-Stedman was advised that the decision currently before the meeting related to the principle of a protocol for the introduction of gating orders and that specific requests would be considered at future meetings.

Mr Fell advised that paragraph 3 of the protocol had been drafted from legislation and could not be modified. The protocol would allow for consistency when considering whether or not to take applications forward and advised that there were currently 6 requests.

Cabinet Member’s Comments

Councillor Robertson anticipated that there would be a number of requests for such orders and it was important to be able to prioritise them in an equitable manner. He asked that all members of the Council be advised of the decision taken.

Decision

Having regard to the arguments and options set out in the documentation before me, the representations made to me and the further considerations set out above, I confirm my decisions on this matter as follows:

To approve the Protocol for the assessment of requests for gating orders as set out at Annex 1 (download as. doc file to the report CMDT4.
