Statement of Decision

 

Exclusion of Residential Properties from Various Controlled Parking Zones Orders, Oxford

Letter from BrookStreet des Roches in respect of 7 Nelson Street

A copy of the report is attached to the signed copy of this decision. The letter in respect of 7 Nelson Street is attached to the addenda sheet for the meeting.

 

Summary of representations in person

 

Mr Turner (75A Cardigan Street) supported the recommendation enabling renewal for one more year before exclusion was implemented and thanked County officers for their help in dealing with his case.

 

Similarly Simon Nagel (30A Cardigan Street) welcomed the decision to extend the application deadline to May 2009. However he referred to the possibility that his research work at the John Radcliffe could extend beyond that date by a short period and asked if the deadline could be extended if that was the case.

 

Emily Cocking (7 Nelson Street) referred to misinformation regarding exclusion when the property had been originally purchased and that no information had been revealed in local searches.  She supported the recommendation not to exclude the property from permit eligibility.  

 

Councillor Armitage referred to the need for the County and City Councils to work together in order to establish car free development.  He referred to problems which had arisen as a result of the development of the former Horse and Jockey and advised that he had not been informed of these proposals as local member prior to public consultation.  He felt that officers had come to the best available recommendation in each case and supported Dr Nagel’s representations to extend the deadline if necessary.

 

Mr Tole accepted that there had been problems in the past addressing conditions applied by the City Council but the intention was now to resolve these issues as soon as possible.

 

With regard to the properties at 75 and 30A Cardigan Street he felt the proposal to extend the renewal period for one year was correct and in the case of Dr Nagel was happy to support an extension if necessary.  With regard to 7 Nelson Street the proposals should be withdrawn and looked at again in the light of the latest information.

 

He apologised to Councillor Armitage for the lack of consultation on the proposals.

Councillor Hudspeth welcomed moves to deal with problems between the City and County Councils with regard to these issues.

 

Decision

 

Having regard to the arguments and options set out in the documentation before me, the representations made to me and the further considerations set out above, I confirm my decisions on this matter as follows:

 

to agree implementation of proposed revisions to the various Traffic Regulation Orders governing Oxford controlled parking zones as advertised subject to:

 

(a)       those exceptions described in the report CMDT4;

 

(b)       deferral of proposals in respect of 7 Nelson Street to enable further investigation.
