ITEM PF24
PENSION FUND COMMITTEE – 28 MAY 2008
PAYMENT OF DEATH GRANT
Report by Assistant Chief Executive & Chief Finance Officer
Introduction
1. The Local Government Pension Scheme Regulations (1997) state that if a scheme member dies before his 75th birthday, the administering authority at its absolute discretion may make payments to or for the benefit of the member's nominee or personal representatives or any person appearing to the authority to have been his relative or dependant at any time.
2. This report asks the Committee to exercise its discretion under these Regulations.
Background Information
3. A now deceased scheme member made a nomination in 1997 requesting any death grant to be split equally between his partner and their son.
4. The member retired in 2004 and the ex partner notified the Authority of the members’ death in March 2008. Subsequent correspondence has confirmed that the scheme member and his partner ended their relationship some 11 years ago. Their son still lives with his mother.
Payment of Death Grant
5. In view of the time elapsed since the nomination was made and the change in personal circumstances this report asks the Committee to exercise its discretion to make payment of the whole death grant to the son.
RECOMMENDATION
6. The Committee is RECOMMENDED to agree that payment of the death grant should be made solely to the son of the deceased scheme member.
