PLANNING & REGULATION COMMITTEE –

IMPORTATION OF INERT WASTE FOR THE CONSTRUCTION OF STABILISATION BERM AND ACCESS RAMP, AT THE FORMER CEMENT WORKS AND QUARRY, SHIPTON-ON-CHERWELL, NEAR KIDLINGTON, OXFORDSHIRE (APPLICATION NO. 02/02602/CM)

CONSULTATION REPLIES

Cherwell District Council

No objections but make the following comments:

  1. the advice of the District’s Head of Environmental Services should be sought with regard to likely noise disturbance to properties in Bunkers Hill and Shipton-on-Cherwell;
  2. a routeing agreement should be entered into and monitored/reviewed to ensure that any disturbance to residential properties is kept to a minimum;
  3. English Nature should be asked to confirm that they are entirely satisfied that the scheme is not harmful to the SSSI;
  4. a scheme for final restoration of this end of the quarry should be sought and implemented.

Cherwell District Council Environmental Health Officer

No objections.

English Nature

Object to the application as the proposed berm will cover one of the faces of the SSSI, so harming the interest of the site. However, this objection would be withdrawn provided the following conditions are attached to the planning application:

  1. before and during construction of the berm, the developer shall provide access to the face so that detailed monitoring and recording can take place;
  2. the monitoring and recording must take place at sufficiently regular intervals to ensure that the detailed geology of the whole face is recorded;
  3. a geologist employed or contracted by the developer will undertake the recording. The geologist must be competent to carry out the monitoring and recording of the face;
  4. the results of the monitoring and recording are to be published in a suitable journal within the public domain.

English Nature also requests that reasonable steps be taken to further the conservation and enhancement of the SSSI.

Kirtlington Parish Council

Express concern about a number of Earthline lorries that are coming through the village as they were under the impression that there was a routeing agreement in force to prevent this happening.

Civil Aviation Authority

No safeguarding objection subject to the following conditions:

  1. any external lighting to be agreed;
  2. landscaping proposals should not increase the risk of bird strikes to aircraft operating from the nearby aerodrome.

Oxford Ornithological Society

Has concerns over possible destruction of bird habitats particularly stock domes, for the ringed plovers and little ringed plovers. These birds especially breed in the vegetation at the top of the cliffs. In more general terms, unhappy with the piecemeal manner of the operations that are taking placed in the quarry. The previous application for car storage was allowed on the basis that an agreement was signed which returned the site to a carefully planned combination of wildlife and low-key leisure activities. No concern was experienced at the time about the condition of the cliffs in this area of the quarry.

Oxford Green Belt Network

It is difficult to object to this proposal if there is a problem concerning the A.4095 and the water main and that work has already been undertaken to stabilise other faces in the quarry. Refer to Paragraph C.7 of Annex C in PPG2 which states that redevelopment proposals should be put forward in the context of comprehensive, long term plans for the site as a whole. Reference is made in the application to a lake feature with low level recreational activity. This may be a good long term solution but wonder whether this is a goal or just a general aspiration. Any works at Shipton should be part of a comprehensive plan for the whole site. Hope that monitoring of the cliff face by a qualified geologist is carried out before any berm construction takes place.

Third Party representation

There has been one letter received from a local resident objecting to the proposal on the grounds of increased traffic, noise, dust and mud on the road.

A copy of the letter is kept on the application file held in the Land Use Planning Section of Environmental Services.
