PLANNING & REGULATION COMMITTEE –

INSTALLATION OF INERT WASTE RECYCLING FACILITY FOR SECONDARY AGGREGATES AT THE FORMER CEMENT WORKS AND QUARRY, SHIPTON-ON-CHERWELL, NEAR KIDLINGTON, OXFORDSHIRE - (APPLICATION NO. 02/02330/CM)

 

RELEVANT PLANNING POLICIES

Oxfordshire Structure Plan 2011:

Policy EN1 - The nature, size, location or cumulative effects of a development should not have an unacceptable environmental impact.

Policy EN5 (b) - The following sites of at least national importance will be protected from damaging development:

      1. sites of European wildlife importance;
      2. National Nature Reserves and Sites of Special Scientific Interest; and
      3. sites which support specially protected species.

On other sites of acknowledged nature conservation importance development will be permitted only if there is an overriding need or if damage to the ecological interest can be prevented by the use of conditions or planning obligations.

Policy G4 - Within the Green Belt around the built up area of Oxford, land will be kept permanently open and development severely restricted. The purposes of the Green Belt are to:

      1. preserve the special character and landscape setting of Oxford;
      2. check the growth of Oxford and prevent ribbon development and urban sprawl;
      3. present the coalescence of settlements;
      4. assist in safeguarding the countryside from encroachment;
      5. assist in urban regeneration, by encouraging the recycling of derelict and other urban land.

Development in the Green Belt is inappropriate unless it maintains its openness and does not conflict with the purposes of the Green Belt and, in the case of new buildings, is for:

    • agriculture and forestry;
    • essential facilities for outdoor sport and outdoor recreation, cemeteries and other similar uses of land which preserve the openness of the Green Belt and do not conflict with the purpose of including land in it;
    • limited extension, alteration or replacement of existing dwellings;
    • limited infilling in existing villages, and limited affordable housing for local community needs;
    • limited infilling or redevelopment of major existing developed sites identified in local plans.

Care will be taken to ensure that the visual amenities of the Green Belt are not injured by development within, or conspicuous from, the Green Belt which, although not prejudicial to its main purpose, might be inappropriate by reason of siting, materials or design.

Policy WD1 - Provision will be made and proposals encouraged to minimise waste generation, increase re-use and recycling of materials, convert waste to energy and use landfill gas as energy, and reduce the amount of waste which has finally to be disposed of by landfilll.

 

Oxfordshire Minerals & Waste Local Plan:

Policy W3: - Proposals for re-use/recycling normally permitted provided that:

        1. site is close to source of waste and/or market for the re-used/recycled material;
        2. the site is well related to appropriate parts of the transport network, and located where the number and length of motorised journeys is likely to be minimised;
        3. the proposal will not cause unacceptable nuisance in terms of noise, dust, fumes, smell, visual intrusion or traffic;
        4. the proposal will not pose an unacceptable risk to the water environment;
        5. the proposal does not conflict with Structure and Local Plan policies.

Policy W4 - Proposals for re-use/recycling and ancillary processes will not normally be permitted in the open countryside unless:

      1. there is an established overriding need and there is no other suitable site available and/or,
      2. the development is to form part of a mineral extraction/landfill site and will be removed on completion of extraction/landfill.

Policy W5 - In all cases waste treatment plant, buildings, machinery and stockpiles must be properly screened from the surrounding landscape. Such screening – by landscaping or other means – should be in place before any waste stockpiling or treatment begins.

Cherwell Local Plan:

Policy GB1 - There will be a green belt around the built up area of Oxford, approximately 6.4-9.6 Km (4-6 miles) wide, where development will be severely restricted. The purposes of the green belt are to:

      1. protect the special character of Oxford and its landscape setting,

      1. check the growth of Oxford and prevent ribbon development and urban sprawl, and
      2. prevent the coalescence of settlements.

Inside the green belt, approval will not be given, except in very special circumstances, for development other than for agriculture, forestry, recreation, cemeteries, or for other uses of land which preserve the openness of the green belt and do not conflict with the purposes of including land in it. Residential infilling or other appropriate development in settlements in the green belt may be permitted provided it does not conflict with the purposes of the green belt or its open and rural character. Some settlements within the green belt will not be covered by green belt policies in order to allow limited expansion.

Care will be taken to ensure that the visual amenities of the green belt are not injured by development within, or conspicuous from, the green belt which, although not prejudicial to its main purpose, might be inappropriate by reason of siting, materials or design.

Policy ENV1 - Development which is likely to cause materially detrimental levels of noise, vibration, smell, smoke, fumes or other type of environmental pollution will not normally be permitted.

 

Revised Deposit Draft Cherwell Local Plan

Policy GB1 - Within the green belt proposals for inappropriate development will not be permitted unless the applicant can demonstrate that very special circumstances exist, development proposals within or conspicuous from the green belt which, although not prejudicial to its main purpose, might be visually detrimental by reason of their siting, materials or design will not be permitted.

Policy GB7 - Proposals for the redevelopment of the worked area of Shipton-on-Cherwell quarry and the cement works, identified in this plan as a major developed site in the green belt, will not be considered inappropriate development provided they are set within the context of a comprehensive plan for the whole site and meet the following criteria:

      1. the proposals would have no greater impact than the existing development on the openness of the green belt and the purposes of including land in it and where possible have less;
      2. the proposals would contribute to the achievement of the objectives for the use of land in green belts;
      3. the proposals would secure acceptable environmental improvement of the whole of the major developed site;
      4. the proposals would include the removal of all existing plant and buildings on the whole of the major developed site;
      5. the traffic and travel implications of the proposals are acceptable, taking into account the previous levels of employment and traffic generated by the site;
      6. the amount of new building floorspace would not occupy a larger area of the site than the existing building footprint;
      7. the proposals maximise the opportunity to make use of the railhead and the Oxford Canal adjacent to the site;
      8. the proposals would not result in damage to or loss of the Site of Special Scientific Interest, and would be compatible with the ecological value of the site;
      9. the proposals would not injure the visual amenity of the green belt and (where new buildings are proposed) will include a significant reduction in height compared to the existing cement works;
      10. no development is constructed below the level which is likely to flood naturally (64.5 metres AODN); and
      11. the proposals would not have an adverse impact on the Oxford Canal.

Consent granted for redevelopment will include a requirement that any existing planning permission applying to the site be revoked without compensation.

Policy R5 - The Council will permit, as part of a programme for environmental improvement, proposals for the restoration and use of Shipton-on-Cherwell Quarry for informal outdoor recreation provided the development would not result in damage to, or loss of a Site of Special Scientific Interest, and is compatible with the ecological value of the site
