RELEVANT PLANNING POLICIES

Oxfordshire Structure Plan 2011 (1998):

G1 The general strategy is to provide a sustainable planning framework for development to meet housing, economic and other requirements over the period 1996 to 2011 in ways which will:

    1. help to meet the objectives of regional policy to secure a shift in the balance of development from the west to the east of the region;
    2. protect the environment, character and natural resources of the county by restraining the overall level of development;
    3. favour locations where:

    1. the need to travel, particularly by private car, can be reduced;
    2. walking, cycling and the use of public transport can be encouraged; and
    3. a reasonable range of services and community facilities exist or can be provided;

    1. concentrate developments which generate a lot of journeys in locations which are, or are capable of being, well served by public transport;
    2. make the best use of land and buildings within built up areas to reduce the need for the development of green field sites, while not permitting development on important open spaces.

The preferred locations for development will be Banbury, Bicester, Didcot and Witney.

In rural areas, local plans will make appropriate provision for development and in doing so will have particular regard to the economic and social well-being of local communities.

G2 All development should:

    1. be of a scale and type appropriate to the site and its surroundings;
    2. incorporate a high quality of layout, design and landscaping; and
    3. be designed so as to reduce the need to travel and encourage the use of walking, cycling and public transport and telecommunications as alternatives to the car.

T18 Proposals for development should be permitted only if they are acceptable in the light of the following criteria:

    1. the existing transport situation, the aims of the local transport strategy and existing local car parking and traffic management measures;
    2. access for pedestrians, cyclists and those whose mobility is impaired;
    3. the requirements of public transport;
    4. the impact of generated traffic including servicing traffic on existing settlements and roads;
    5. highway access and servicing arrangements;
    6. the safety of all highway users;
    7. the likely resource implications for the highway authority.

EN1 The nature, size, location or cumulative effects of a development should not have an unacceptable environmental impact.

EN12 Development in the flood plain, or which would result in an unacceptable risk of flooding, will not be permitted unless appropriate flood protection and compensation measures can be provided.

WD1 Provision will be made and proposals encouraged to minimise waste generation, increase re-use and recycling of materials, convert waste to energy and use landfill gas as energy, and reduce the amount of waste which has finally to be disposed of by landfill.

WD2 Provision will be made to treat and/or dispose of all of Oxfordshire’s waste except for that which requires specialised facilities of a sub-regional or regional nature.

Oxfordshire Minerals and Waste Local Plan (1996)

WD4 Proposals for re-use/recycling will normally be permitted provided that:

    1. the site is close to the source of the waste and/or the market for the re-used/recycled material;
    2. the site is well related to appropriate parts of the transport network, and located where the number and length of motorised journeys is likely to be minimised;
    3. the proposal will not cause unacceptable nuisance in terms of noise, dust, fumes, smell, visual intrusion or traffic;
    4. the proposal will not pose an unacceptable risk to the water environment;
    5. the proposal does not conflict with Structure and Local Plan policies.

Cherwell Local Plan (1996)

EMP1 Employment generating development will be permitted on the sites shown on the proposals map, subject to the other relevant policies in the plan.

ENV8 In the areas at risk from flooding, new development, the intensification of existing development or land raising will not normally be permitted. Where development in such areas is permitted, appropriate flood protection and mitigation measures will generally be required as part of the development.

Cherwell Local Plan 2011 Deposit Draft (2001)

S5 The area between Britannia Road and Back Edward Street, and Swan Close Road and Merton Street as shown on the proposals map is designated a mixed use area. Development proposals will be permitted provided that they:

    1. Contribute positively to the regeneration of the area and do not prejudice the implementation of new routes and public spaces described below.

    1. Incorporate proposals to minimise the impact of traffic associated with the development.

Land will be reserved for the following footway/cycleway routes which are considered essential:

(xvi) North and east from the railway station to Grimsbury.
