BUILDING TO HOUSE A MATERIAL RECOVERY FACILITY (MRF)OFF MERTON STREET, BANBURY (APPLICATION NO 01/01033/OCC)

Consultation Responses and Representations

Cherwell District Council – Planning

Object to the proposal:

  1. It would severely prejudice the implementation of Draft Policy S5 of the deposit Cherwell Local Plan 2011 by consolidating industrial ‘bad neighbour’ uses on the site which would be inappropriate adjacent to the proposed residential uses on the site.
  2. It would prevent the construction of an east/west footpath/cycle link over the railway.
  3. It would be likely to result in increased traffic movements in Bridge Street and Middleton Road which are already congested.
  4. It lies in the floodplain and is contrary to policy ENV8 of the adopted Cherwell Local Plan.

Cherwell District Council – Environmental Health

Whilst the building itself may offer some attenuation of the noise from the adjoining railway line the supporting document does not indicate the level of noise operations within the building. Need more details on noise and dust impacts.

British Waterways

No objection.

Environment Agency

Letter dated 28 June 2001. Holding objection on flooding grounds until a plan showing representative levels over the site above Ordnance Datum is submitted by the applicant.

Letter dated 15 February 2002. The site does not lie within the floodplain and the E.A. remove their holding objection on flooding grounds.

Banbury Town Council

No objection.

Highways Agency

No comment.

Bankier Sloan, Chartered Surveyors on behalf of De Boer Structures Ltd

Object to the proposal as it would conflict with the proposed re-development of the area.

RPS Group Plc on behalf of Kings Oak, South Midlands

Object to the proposal as it is in conflict with the emerging Cherwell Local Plan, in particular policy S5. The proposed MRF would by reason of noise and nuisance disturbance adversely affect the amenities of future occupiers of dwellings and premises on the Cattle Market site. The proposed building would create a visual impact for users of the Cattle Market site.

The MRF would potentially generate more traffic than stated.

In the event of planning permission being granted restrictions should be imposed on traffic, working hours and noise.
