RENEWAL OF ADMISSION AGREEMENTS

Introduction

  1. The Local Government Pension Scheme Regulations (LGPS) enable other employers to join the Pension Fund. Until recently, application to join was restricted to employers providing a not for profit public service, or whose funding came directly from a public body. Oxfordshire Pension Fund has many contributing employers who have joined using this route, entering into an Admission Agreement with the County. Some agreements date back to 1974. Over time, the work of these bodies may change or a management committee will decide that a change of name is necessary to better reflect the modern aims of the service. We have recently been advised of the change of name of two such bodies.
  2. The Elmore Committee

  3. The Elmore Committee has been an employer within the Oxfordshire Fund since 5 December 1977. Earlier this year the Committee instigated a review of services and has compiled new articles of association becoming a company limited by guarantee. Their service is now being provided under the name of Elmore Community Services. The changes do not affect their ability to comply with the regulation requirements for a fund employer.
  4. Witney and District Citizens Advice Bureau

  5. This employer joined the Oxfordshire Fund in April 1998. The name changed to West Oxfordshire Citizens Advice Bureau on becoming an incorporated company, limited by guarantee. There is no change to the eligibility to be an admitted body employer under the terms of the LGPS.
  6. Action

  7. I have consulted the County’s Legal Department for advice on amending the legal agreements existing between these employers and the County Council. The recommendation is to prepare updated admission agreements, based on the new names and the current regulations, but linking in with the previous arrangements.
  8. The changes these employers have adopted would not affect their eligibility to be admission bodies if they were applying today, and renewing the agreements using the most recent legal agreements will provide an opportunity for all parties to be up to date.
  9. Committee’s approval is necessary to prepare the legal agreements.
  10. RECOMMENDATIONS

  11. The Committee is RECOMMENDED to approve the renewal of the admission agreements to be effective from the date of change of name for:
          1. Elmore Committee to Elmore Community Services; and
          2. Witney and District Citizens Advice Bureau to West Oxfordshire and District Citizens Advice Bureau.
