On
4 March 2004, the Transport Implementation Committee considered a report
by the Head of Transport (TIC5), a copy of which is attached (EN4).
The report sought approval for amendments to the Summertown Residents’
Parking Scheme. The Executive has also considered the issue at its meeting
on 15 April 2003. The report can be viewed on the Council’s website.

On
4 March 2004, the Transport Implementation Committee resolved:
- approve the
overall scheme shown on Plan No 721/AO/3015 Rev A, but with the following
amendments:
- Beech Croft
Road : Change the restrictions outside Nos. 35 and 37 Beechcroft
Road from Resident Permit Holder Only 8am to 10pm Mon to Sun to
No Waiting at Any Time (Plan No HM721/A3/3006 Rev A);
- Beech Croft
Road : Change the two restrictions outside the Woodstock Road Baptist
Church in Beechcroft Road from 3 Hour Parking, 8am to 6.30pm Mon
to Sun to 3 Hour Parking 8am to 6.30pm Mon to Sun, Permit Holders

having considered the objection to the scheme made by Spratt Endicott,
Solicitors regarding the omission of a Conference Permit Parking Scheme
from the proposals, to support the officer recommendation to confirm
the Order as advertised;
d.
to instruct Control Plus to patrol Hamilton Road, Lonsdale Road, Portland
Road and Victoria Road three times each day for the first three months
of operation and ask officers to report back to the Executive Members
for Transport and Sustainable Development at the end of and during
that period;
e. ask
the City Council to consider removing the provision for a taxi rank
in Oakthorpe Road;
f. provide
double yellow lines along the frontage of 6 Lonsdale Road;
g. instruct
the Head of Transport to proceed with the design and implementation
of the North Summertown Zone in the next two financial years, subject
to the necessary resources being available.
On
11 March 2004, the Assistant Chief Executive received a request signed
by 10 Members of the Council in accordance with the Council’s Scrutiny
Procedure Rules set out in the Constitution in the following terms:
"We
request that the Proper Officer of the Council calls in the decision
of the Transport Implementation Committee taken on 4th
March 2004 and listed at Item 5 of the list of decisions –Summertown
Controlled Parking Zone.
The
reason for our request is that the consultation process is alleged
by some residents to have been seriously flawed, a view which is supported
prima facie by the assertion contained within the report that the
81% of residents who did not respond to the consultation could be
taken as being in favour of the proposed scheme. ("The remaining
1312 (81%) did not reply. The overall conclusion from this is that
the scheme seems to have been favourably received…"). Since the
nature of the proposed Parking Zone is such that the impact on the
homes and lives of residents is likely to be considerable, we feel
that a more considered view and judgement of the proposals, the consultation
and the inferences to be drawn from the consultation should be taken.

If,
having considered the decision, the Scrutiny Committee has material
concerns about it, then it may refer it back to the Executive for
reconsideration, setting out in writing the nature of its concerns.
If referred to the Executive, the views of the Scrutiny Committee
will be considered by that body within a further 10 working days,
and the decision will then be amended or otherwise and take immediate
effect. If it is not referred back to the Executive then the decision
is implemented from the date of this meeting.
The
Scrutiny Committee is asked to decide whether:
- to
refer the issue back to the Executive with comments; or
- to
accept the Executive’s decision.
