CARTERTON-A40
LINK ROAD – SUBMISSION OF SIDE ROADS ORDER

Introduction
- The Carterton-A40
Link Road will link North East Carterton with the B4477 Minster Road
north of Brize Norton village, thereby providing a bypass of Brize Norton
for the main Carterton-A40 route. Its route is shown on Annex 1.(download
as .doc file). It will be financed by the developer of North
East Carterton in accordance with an agreement made under Section 106
of the Town and Country Planning Act 1990. Under the agreement the link
road has to be open to traffic before the number of occupied dwellings
in the North East Carterton Development reaches 400.
- Existing roads
will have to be permanently diverted locally, a length of existing highway
will have to be stopped up, and private means of access to premises
will have to be stopped up when the link road is built. Therefore it
will be necessary for the County Council as the Highway Authority to
exercise its powers under the Highways Act 1980 to make a Side Roads
Order and submit that Side Roads Order to the Secretary of State for
Transport for confirmation. This report recommends that the Side Roads
Order be published, and submitted to the Secretary of State for confirmation.
Background
- The North East
Carterton development, including the Carterton-A40 Link Road south of
the existing Burford Road, was granted planning permission, reference
W97/0843, on 10 February 1998. The construction of the Carterton-A40
Link Road from Burford Road to the B4477 Minster Road was granted planning
permission, reference W98/1392, on 9 November 1998. The developer already
owns all the land required. The design and construction is being managed
by the developer`s consulting engineers. The preparation of the draft
Side Roads Order is being carried out by the County Council`s consulting
engineers, The Babtie Group.
Environmental Implications
- The Carterton-A40
Link Road will relieve Brize Norton village of the increasing amount
of through traffic going between Carterton and the A40 dual carriageway
to the east. For most of its length between Burford Road and Minster
Road, it will be in a cutting and will not intrude into the rural landscape.
No lighting is planned on this length except on the approaches to junctions.
Financial and Staff
Implications
- Babtie`s fees
and the County Council`s staff time costs in connection with the Side
Roads Order preparation will be rechargeable to the developer. Staff
of Environmental Services will be involved in managing Babtie`s work
and dealing with the developer`s consulting engineers, the Department
for Transport, and members of the public. Staff of the Business Directorate
Legal Unit will be involved in the publication, and submission of the
Side Roads Order to the Secretary of State and with all relevant procedures
to obtain confirmation of the Side Roads Order. The amount of time required
for each member of staff is not expected to be large, provided that
there are no unresolvable objections to the Side Roads Order. However
should there be any objections which could not be resolved, then there
would have to be a Public Inquiry, which would require a large amount
of staff time.
RECOMMENDATION
- The Committee
is RECOMMENDED to authorise the publication and submission to the Secretary
of State for confirmation of a Side Roads Order which will be necessary
to enable the construction of the Carterton-A40 Link Road to proceed.
