(Statement of Decision)

 

In October 2002 terms were agreed for a lease of an area of surplus land at Orchard Meadow School, Blackbird Leys to Oxford City Council for a term of 7 years at nil rent   with a sub lease to be granted to the Blackbird Leys Adventure Playgroup Management Committee. 

 

The City Council decided not to proceed with the lease.  Subsequently they approached the County Council with a request to extend the original 7 year term to 12 years at nil rent to enable the Blackbird Leys Adventure Playgroup Management Committee to apply for Lottery funding which requires a lease in excess of seven years. 

 

This reports sets out the implications of a temporary disposal for less than market rent and seeks approval for such disposal.

 

The Cabinet Member for Finance is RECOMMENDED to approve the temporary disposal of surplus land at Orchard Meadow School, Blackbird Leys to Oxford City Council by way of a 12 year lease at less than market rental value.

 

EXEMPT ITEM

 

It is RECOMMENDED that the public be excluded for the duration of item 3E since it is likely that if they were present during that item there would be disclosure of exempt information as defined in Part I of Schedule 12A to the Local Government Act 1972 (as amended) and specified below in relation to the item and since it is considered that, in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information on the grounds set out in the item.

 

THE REPORTS RELATING TO THE EXEMPT ITEM HAS NOT BEEN MADE PUBLIC AND SHOULD BE REGARDED AS STRICTLY PRIVATE TO MEMBERS AND OFFICERS ENTITLED TO RECEIVE THEM.

 

3E.    Land at Church Farm Thame

This report seeks approval to a disposal at less than the full market value following the decision of the Capital Steering Group on 29th June 2007 to grant a long leasehold interest of land at Church Farm Thame to the Thame football Partnership.

 

Provision for a disposal at less than full value is given in the General Disposal Consent (England) 2003 adopted by the Executive in October 2003.

 

The public should be excluded during this item because its discussion in public would be likely to lead to the disclosure to members of the public present of information in the following prescribed category:

·        Information relating to the financial or business affairs of any particular person (including the authority holding that information)

 

and since it is considered that, in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

 

The Cabinet Member for Finance is RECOMMENDED to adopt the recommendation in report CMDF3E
